It does not include information that has been fully anonymized or aggregated such that it can no longer be traced back to you.

By using the Site, booking an appointment, or availing any of our services, you voluntarily provide us with personal information — which may include medical information — and consent to its collection, use, and disclosure as set out in this Privacy Policy. If you are sharing information on behalf of someone else (for example, a family member or a minor), you confirm that you are authorized to do so.

4. How We Share Your Information

We share information only as needed to provide our services, and require anyone we share it with to protect it to an equivalent standard:

Medical staff and specialists at ASMII / Comet Eye Hospital directly involved in your care
Service providers who support Site hosting, appointment scheduling, payment processing, communications (including WhatsApp Business or SMS gateways), and analytics, under confidentiality obligations
– Legal or regulatory authorities, where required by law, court order, or to protect the rights, safety, or property of ASMII, our patients, or others
– Business transfers — in the event of a merger, acquisition, or sale of assets, subject to the same confidentiality protections

We do not share your health records with any third party for marketing purposes without your explicit consent.

4.1 Cross-Border Data Transfer
Some of our service providers (for example, cloud hosting or analytics platforms) may process data on servers located outside India. Where this occurs, we take reasonable steps to ensure such providers apply data protection standards consistent with this Policy and applicable Indian law. By using our Site, you consent to this transfer where applicable.

5. Protection of Sensitive Health Data

Given the sensitive nature of medical information, we apply additional safeguards, including:
– Restricted access to patient records on a need-to-know basis
– Secure storage of physical and digital medical records
– Confidentiality obligations binding on all staff and specialists
– Secure transmission practices for any data shared electronically

Despite these measures, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

6. Data Retention

We retain your personal information for as long as necessary to provide our services or as required under applicable law, including medical record-keeping regulations. De-identified or aggregated data may be retained longer for research and statistical purposes, subject to legal requirements.

If you discontinue services with us, we have no obligation to retain your data indefinitely and may delete it — except where retention is necessary to comply with legal obligations, prevent fraud, or resolve disputes.

7. Your Rights

Under the Digital Personal Data Protection Act, 2023 (DPDP Act) and other applicable law, you have the right to:
– Access the personal data we hold about you
– Request correction or updating of inaccurate or incomplete data

If you choose not to share certain information, or withdraw consent for information you’ve already given us, we may not be able to provide the services for which that information is necessary.

To exercise any of these rights, contact our Grievance Officer using the details in Section 12.

8. Confidentiality and Information Security

We use reasonable technical, administrative, and physical security measures to safeguard the information you share with us, and maintain internal policies to prevent unauthorized access. We also require third parties we share data with to adopt equivalent security practices.

We are not responsible for loss, unauthorized access, or harm arising from misuse of your personal information, unless it is a direct result of our own negligence or non-compliance. If you suspect any unauthorized access to your account or data, please notify us immediately using the contact details in Section 12.

Our Site uses cookies and similar technologies to:
– Remember your preferences
– Understand how visitors use our Site (via tools such as Google Analytics)
– Improve Site performance and content relevance

Cookies used for these purposes do not store your Personal Information directly. You can control or disable cookies through your browser settings; doing so may limit some Site features.
